Failure to File a Charge with the DFEH will preclude your right to file a lawsuit in State Court for this discrimination, harassment , retaliation, violation of the California Family Leave Act, etc.

The Department of Fair Employment and Housing of the State of California will take complaints, called Charges, of employment discrimination including discrimination due to age, race, sex, physical disability, mental disabilty, pregnancy, national origin, marital status, and complaints for sexual harassment and/or for retailation by your employer for complaining about any of the above. These must be filed within one year of the the act being complained of or, in the case of a continuing violation, the last act complained of. The Charge with the DFEH must be timely filed in order to exhaust your administrative remedies, a prerequisite for filing a lawsuit in State Court. You may file for as many categories of discrimination that you believe apply. You may lose your right to bring a lawsuit on a category if it was not checked. Therefore you should check all that you think apply. Check continuing and give the dates if the discrimination, harassment, and/or retaliation complained of is continuing.
